    LAWYER COMPETENCY PLUS CLIENT COMPETENCY
    Any of us who are extremely competent in matters of the law are often better tacticians than the law firms we employ.
    There is a simple reason for it: we have more knowledge of self and opposition than the lawyers do; we know how the opposition can deceive better than the lawyers do; we know the subtleties of our industries better than the lawyers do and therefore the ‘schemes’ that both sides can employ; the constraint on lawyers is greater than plaintiff or defendant; the lawyers have reputations in court and are often known by the judge, so they are more cautious in relation to the judge – though most lawyers are better at defending against this than others.
    In my experience, in matters of responsibility and blame (guilt) we are often better than our lawyers. As a matter of court procedure, and knowledge of the legislation, regulation, and prior findings of the court (much of what lawyers do), they are usually far superior. So the combination of client and lawyer competency plays out in court.
    I’ve had to resist blurting out that something a judge, opposing counsel, or prosecutor has said that’s profoundly illogical, stupid, or ignorant more times than I can count. And sometimes you wonder how the entire system works at all below the appellate level.
    And so, this is one of the best reasons for juries. Juries are surprisingly good at detection of dishonesty and incompetence. And this is why it is always best in business to ‘do the right thing’ because if you explain that to the jury, even if the outcome wasn’t expected, you’ll have an advantage.
    The continued deprivation of the people from juries and even from juridical defense, in addition to the ‘privileges’ the court has granted itself through procedure, or via the legislature, combined with the total failure of positive law (divorce, education, involuntary association) is the reason for the decline in public respect for the court, the legislature, and the law.
    Citizens can only do the right thing as long as legislatures and judges do. This is why rule of law and only rule of law by the natural law (what we had) is the means of providing the optimum political order of cooperation.

    Depends on the meaning of the term.

    A king/queen is a chieftain(headman) that may be elected or hereditary. A monarchy is a king/queen under the european common law, christianity, and is hereditary. A Constitutional monarchy explicilty states the powers of all branches of government. With the present british monarchy the optimum power in theory though it’s almost never exercised: the power of veto/ascent over legislation and cabinet, the power to disband the government, the power to call up the military. These are ’emergency’ powers necessary to compensate for the folly and fashion of the people, and the tendency of governments to seek power at public expense.

    Under rule of law of the natural law as we have in the united states, and a bit less so in the rest of the anglosphere, we lack a ‘judge of last resort’, to appeal to when the political, legislative and court processes fail us – which they do. HIstorically we could appeal to the manor, to the shire court, to the city court, to the nobility, to the parliament, to the monarchy when we felt an injustice. Who do we have to appeal to now? No one.

    We lack anyone with the authority ‘outside the law in the restoration of the law’.

    We lack the intergenerational political ‘house’ of the Lords (families with demonstrated investment in the polity), and ‘house’ of the monarchy (demonstrated long term investment in the polity) and this leads to the tragedy of the commons where all politicians act as ‘renters’ rather than ‘owners’ and destroy civilizational capital.

    We lack the aesthetic of competitive excellence demonstrated by the monarchies that have made europe a vast open air museum, and without them progress toward favelas.

    So the ‘perfect government’ consists of rule of law by the natural law of self determinatino by sovereignty and reciprocity, a constitution of that law stating the sovereignty of the people under the natural law, a parliamentary house for each the classes creating market for the production of commons, including a house of intergeneratinoal families with demonstrated devotion to high culture, and a monarchy as the judge of last resort.

    We got most things right.
    But we were wrong about aristocracy.
    And we were ‘wronger’ in the enlightenment presumption of the virtue and capacity of the common man, and we entirely failed to grasp and account for the seditious nature of the common woman.

    Turns out that everything turns to a Tragedy of the Commons without a nobility and monarchy. And turns out that everything turns ugly without them. Because we are all incentivized to maximize consumption now, rather than invest inthe long term returns on aesthetics, beauty, and excellence.

    In this sense I favore rule of law by the natural law, by the sovereignty of the people within the natural law, the resulting requirement for concurrency in vote and legislation and commonality in dispute resolution (legal concepts you may not know and if you don’t it’s a tragedy of our system that you don’t), universal equality of defense via court, voting by demonstrated competency, houses of government for the production of commons, each corresponding to the sexes and classes, ensuring the prohibition on authority, and the requirement for concurrent consensus, with a hierarchy of means of personal appeal for injustice from court to monarchy, and a monarchy as the intergenerational defense of the commons, the people, and the state, with the ability to act outside the constitution and law in the restoration of that constitution and law.

    That’s perfect government.
    IF you are good enough people to have it.
    And that’s the reason for education – to make sure you’re good enough and responsible enough to have it, so that the rest of us who are, CAN have it.

These three institutions will develop in an order and priority. All civilizations are anchored by their first institution, which is permanent, followed by a second weaker institution, followed by a third weakest or failed institution. As such civilizations adapt given the rate of adaptabiility of their primary institutions: religion slowly if at all (MENA, India), the State(government) faster but calcifying (Sinic), and the law of contract or competitive cooperation via markets the fastest possible (Europe).

    4) But the physical, emotional, and psychological cost to the individual of these institutions, priority of these institutions, and rate of change permissible by these institutions varies by their adaptivity, and *individual responsibility*. With religion the lowest, the state next lowest, and the market the most burdensome. Why? Because the radius of religion is the self and family. The radius of responsibility under the state as dicated. The radius of responsibility under markets is ‘the maximum you are capable of’ because otherwise you are forcing costs upon others in the polity by the absence of your responsibility: equality of responsibility.

    5) The ‘liberal’ project in its prewar christian form was merely duty of care for the unfit, in exchange for training the unfit into greater moral fitness (religions). But the postwar ‘liberal left, socialist, equalitarian program’ ‘sells’ personal irresponsibility, dependence, and infantilization, and promises freedom from the logical(postmodern), physical scarcity(marxist), behavioral(neoMarxist, Feminist, Woke), and Evolutionary Laws(Darwinian explanation for all of existence) to authoritarians.

    6) Conservatives deny the equality of moral willingness, ability, and fitness for moral responsibility.

    7) We deny the utopian and accept the responsibility for the burden of the empirical.

    The only thing to learn from this is that musk’s method of rapid development by hyper experimentation, does not translate to implantable medical devices. And that while Neuralink is the first mover, those that were second movers, ran with his company’s research, and were more cautious in experimentation in preparation for FDA approval have caught up and have not incurred the skepticism of regulators.

    My concern has always been that while Musk and team have been correctd that the most accessible and unabiguous sections of the brain are those of the motorcortex, and as such integration with motor functions that most basic and most possible, that the number of connections necessary to do so might be extremely difficult to achieve. Now, I’ve only seen a few bits of their tech and it’s absolutely amazing. So as far as I know this is another conflict created by the aggressivness of his research and development methods colliding with the backwardness of our regulatory structures. and this collision is itself part of the major disruption he is trying to bring about.

    Similar disruptions have been caused by the Russian strategic production vs american, and now Iraelie military research and development vs american. In other words there is a defect in not only our schools, our academy, our government, that is archaic and needs reform. And musk, the japanese in manufacturing, the Finns in education, the Germans in government, and the Israelies in military procureent are all teaching us what’s wrong with our system that needs ‘modernization’.

    They could not solve the problem of politics (for complex reasons) so confucius directed them to operate as an extended hierarchical family.
    The produced philosophy instead of theology, but reasonablenss over logic, and agreement over truth for the purpose of agreement, and as such face before truth instead of truth before face.
    As such their language remained high context low precision, instead of high precision low context, when the more complext the civilization the more important high precision and low context, because the human brain uses langauge to organize increasingly abstract knowledge.
    They chose harmony and confict evasion over conflict and dispute resolution. They chose order and certainty over liberty and uncertainty. They failed to produce a high trust culture (polity).
    They failed to produce a majority middle class because of it.
    They failed to win the race of scientific, technological, commercial, financial, trade development against the west who solved the problem of politics – and activily discarded instead of allowing the ‘disruption’ of new technologies to spread.
    The answer to the group differences in civilizational rates of evolution computation and adaptation and evolution is, like anna karinena’s families: many things must go right for a happy family or for an advanced civilization to evovlve (mature) from an agrarian to an industrial, and if any of those things goes wrong, especially in the distant past, then ‘you can’t get there’.
