Studying legal papers and theory you quickly learn that law is ignorant of economics and scale. You learn that the problems lawyers and the courts face are problems of economics and scale. You learn that they are trying to solve a social science problem with a crude instrument that changes slowly. Jurist and Lawyers have seen the atomic but not the aggregate. and so it creates a kind of disciplinary blindness. The problem with the profession is that while we have common and continental law, we have lost or only just discovered natural tort law, which solves problems of juridical decision making, where conflating the law with legislation and regulation and to some degree command, create all those problems of interpretation.

I have the AGENCY to consider all possibilities and choose the moral, amoral, or the immoral as required. This is the lesson of sun tzu, machiavelli, and aristotle – as well as every other general: morals are not truths but utilities, not knowledge but habits. The great books of wisdom and strategy are written so that we do not make the mistakes of christians and allow ourselves to be conquered, for having forgotten how to fight. They are written to ensure that we are civilized by reason not by habit.. I have agency. I am not an animal. My intuitions provide information only. My reason rules my decisions. Moral, amoral, immoral, as needed.

WOMEN FOR SUPERGEEKS Women are easy. Take them shopping. Be nice to their friends, and make her look good in front of them. Listen. Give them permission to feel. Say “yes: to anything that you can easily do so. Say “no I can’t or won’t do that” – not, “no that’s a bad idea” – and don’t ask forgiveness or permission or agreement to say that kind of “no.” That is what it means to be a man and different from a woman. In addition, have male friends and many of them. I love talking through thoughts and issues and ideas with a woman. And honesty in those things makes them feel safe with you. In other words, bring them into your emotional world but not your cognitive world. Bringing them into your cognitive world is a form of selfishness. It makes you needy. If you bring them into your emotional, personal, and social, world, you make them successful in bonding with you. My particular issue is that I can be anchored if I talk about something before I am ready – and being anchored takes away my superpower so to speak. So I can’t talk about some issues until I am ready, and this can create the perception that I am hiding something. Worse, not everyone can understand what I am thinking, so I try to humor people to save myself effort, frustration, and potential alienation, which can also create the impression that I have ‘plans’. Worse, I managing one’s creativity is different from managing one’s work. Creativity is a manageable process but time consuming, and cannot, like ordinary task work, be forced. So it is not always clear that I am in fact (as taleb also laments) ‘working’, when in fact I am, under almost all circumstances, ‘working’ and only vaguely ‘present’. Stuff spills out of your fingertips when it’s ready, not when you want it to. So lots of intimate, in that I mean, ‘us time’ talking is necessary to preserve trust and connection to compensate. And that is what I learned to do. Women give AMAZINGLY GOOD ADVICE on anything personal, emotional, social, and ‘real’. so much so that at least for me it’s very hard to function without it.

CONTINUING YOUR EXISTENCE
by Bill Joslin In three generations (150 years), pretty much all people on the planet will not only be dead – but forgotten. People – average Joe’s – who lived 150 years ago are pretty much forgotten. What impact will you have on the world, during your life, which will still be relevant or even just remembered in 150 years? The point at which the impact of your life upon the world becomes irrelevant and forgotten marks the point where your existence ends. Unless you leave a mark on history, you’re life remains inconsequential, arbitrary and irrelevant – it makes no difference… So, this adds a new dimension to why having kids is meaningful – if you can’t affect an impact on the world via action, you can continue your existence via reproduction. -

The general rule is this: 1) we are super-predators that have evolved a VAST web of proxies for violence in order to retain the REPEATED benefits of cooperation over the LIMITED returns on predation. 2) if you participate in the cooperative market you will observe the effects of these proxies as the REFLECTION of regular demonstration of human behavior. 3) if you participate in the CONFLICT market you will observe the effect of these proxies as OBSCURING the regular demonstration of human behavior. 4) Manners, lack of access to competitors, because of the affinities of people in social groups, and the threat of local ostracization and violence prevent us from and OBSCURE human behavior. 5) Internet (the series travel > written word > media > internet) access to ALLIES and COMPETITORS because of the affinity for combatants (political activists) to seek combat (argument). 6) Therefore, real world social interactions are necessary for safety and for value creation and obscure the vast differences in behavior we can experience directly. Knowledge of competitors (media) exacerbates it. the influence of activists on media exacerbates it. Access to competitors for direct conflict exacerbates it. 7) we solve the problem of cooperation by the blind men eating the elephant. we can only work with what we can touch, and we can only cooperate with those next to us but if we ever come to understand that those who we don’t out of necessity cooperate with will seize the benefits of not doing so whenever the distance from our physical violence permits, they will. I don’t watch television News because it is the worst possible means of obtaining knowledge. I don’t read magazines because they were (are no longer) useful. I don’t really read the news (or pop culture). I do however monitor the social science data and economic data. What changed my mind about following current events, was the proximity of revolution and interest in watching it unfold. -

THE NORMAL WORLD VS THE ABNORMAL HIGH TRUST WEST —“Japanese are basically as irreciprocal and asymmetric as jews – but with a twist. In that, while they don’t like cheating, defrauding, lying, and stealing, etc. that would cause retaliation, they are always asking the question “is it good for japan?” the way jews ask “is it good for jews?” India does that too – the question is always “is it good for india? And they are very clear on ingroup vs outgroup in everything – and not just race, but family. There are different pronouns for things like mother, father, our company, your company, etc. depending on how you are talking to and your relative position. The Vietnamese language is same way. In vietnam its blatantly clear that everything inside is from your fathers side: patriarchy.”– James

In working through a strategy, which I usually do while just walking around, driving, listening to others, or writing, I do not shy from unethical and immoral options any more than I do moral or costly options. Once you find a solution the problem lies only in finding a solution that is not UNETHICAL or IMMORAL. This is the problem with moralizm. You limit yoru scope of conception. Or, you are too weak of character to eliminate the unethical and immoral choices until you find an amoral or moral means of achieving the same end.

When I negotiate in a hostile environment I take the position of holding the moral high ground and ‘stay on message’ creating evidence of a narrative of holding the moral high ground. Most of the time we are punished or sued for honest errors, and get away with our most dishonest and immoral plans. The secret of legal success is holding the moral high ground and betting that the jury will side with you for doing so. I usually go all in and risk the jury. When my peers (board) disagree with me, they lose. Always. I never do a deal where I think I might get sued where I can’t construct a narrative of holding the moral high ground. And the secret is … largely, because you always try to actually do so. its simply the optimum business strategy. There will always be people who think your errors are plans, and don’t see the immoral plans you either did or didn’t take. But build a reputation for never surrendering, favoring litigation, and holding the high ground and it works.

Truth is reality en toto (words can barely do it justice). This is why God (reality) is the flaming sword bearer. This is why having untrue aim is to sin; for an arrow to fly true it adheres to Truth. All your proxies for the truth have blinded you to it; have protected you from it; have given you a false sense of its absence; and truth will be your rude awaking, as youâve been ignoring its soft cries and recent screams. Please understand, until recently your proxies have sufficed. The idea to minimize violence through civilized means is a kind one; we believe in extending kinship. But, the unfit proxies havenât replaced violence as of late; they have merely postponed it. We donât settle issues anymore; we push them off and allow them to stew. Human beings have it in them to fend off the harsh Truths of nature; even of human nature; but the humans show no signs that they will allow their lies to abate; they egg the truth on woefully unprepared for the horrors it has in-store for those whoâve denied it so long. Can we wise up in time? I pray we can; but I promise prayers alone arenât enough. -

When I want to “kill”a company (cause it to collapse) I try to recruit people with grudge, or at least make relationships with people in the company who have a grudge. Every company does something or other totally innocently that is illegal. Then I construct a narrative of intent, and spread it. Then I get insiders to conduct a lawsuit. I have done this a half dozen times. Why? People are selfish and proud and easily provoked to revenge, even at high cost.
