  • Democracy’s Monopoly Commons vs Rule of Law’s Market Commons

    The value of democracy in the selection of commons decreases with the size of the population voting. Why? because the size of the population increases the diversity of interests. And because democracy allows us only to choose between priorities from within common interest – it’s a monopolistic means of choosing which commons to produce. So when we increase in scale, we require markets to conduct exchanges between different common interests, not monopolies, to ignore our uncommon interests.

    Moscow’s conquest of south-eastern ukraine broke not only the postwar consensus on borders, but the peace of Westphalia that made states accountable for the factions inside their borders. To some degree this may help Europeans, and westerners, understand that their definition of war includes the assumption that wars are conducted by states against states rather than by factions within states against states or factions within other states – and that like the high trust society they live in, and the rule of law they live under, or the democracy that they practice, is just another European idiosyncrasy – an artifact of history that like trust, law, democracy, can readily convert to human norms of low trust, corruption, and totalitariansm.

    (important piece) (consolidates concepts) Western Man struggles against discretionary (arbitrary) rule, in an effort to construct a condition of non-discretionary rule: Rule of Law.
    Rule of Law is imposed upon men by the organized use of violence to prohibit discretionary rule. Natural Law (property) provides Perfect Decidability to Rule of law, eliminating the need for discretionary rule. Natural Law prohibits the imposition of costs upon others, by the universal requirement for productive, fully informed, warrantied, voluntary transfer of that which man has homesteaded or obtained such transfers, when the acts were limited to externalities of the same criteria: productive, fully informed, warrantied, voluntary transfer. Common Law evolves incrementally by the identification of new methods of unproductive, insufficiently informed, unwarrantied, involuntary transfers, causing externalities of the same criteria, and adding those prohibitions to the canon of the law. Law of the Commons (Government) evolves: – First by concentrating rent seeking in the central authority, and suppressing familial, tribal, and local rent seeking, enabling each individual to act with his property in his best interests. – Second, the law of the commons evolves by the organization of production of commons, while removing the inability to defect from (free ride upon) the costs of provisioning those commons. – Third the law of the commons evolves to provide insurer of last resort as a service to the commons. – Fourth, the centralized rent seeking is eliminated by the conversion of the functions of insurer, and commons-producer, into a market for the selection of commons and tolerance for insurance. (Contractualism). Constitutions enumerate the processes by which rule of law, using market government, under natural law, is conducted by ordinary men. By use of force to create and fund, then market to persist, the meritocratic order is constructed against the will of the free riders that constitute all but a minority of the population. Man was not oppressed – he has been domesticated as surely as our plants and animals.   • The Non-obvious Benefits Of Market Government

    (important topic) William Butchman just indirectly reminded me that when I say ‘market government’ is the most likely candidate for creating a beneficial form of ‘post majoritarian rule’ while retaining the benefit of creating non-monopolistic commons:
    a) that groups are not prevented from creating what we call anarchic (private contractual) commons, simply by setting conditions of use for the semi-private property. In other words, the Hoppeian contractual model of commons still exists. b) however, by creating a market for the EXCHANGE of commons, we can conduct trades between classes for the construction of commons, thereby obtaining through the exchange of commons what we cannot obtain through either the market, or by the private production of commons. c) the importance of this insight is that we are all compelled to think of what commons we can offer to others just as we are compelled to think of what private goods and services we can offer to others. The most common exchange will be behavior and norms for material goods, services, access and various forms of insurance. d) and that we can create competing commons (monorail vs trains) where before – only monopoly existed. If you can create a commons by wholly private construction, public non-prohibition of private construction, public competition with other common projects, or shared consent via exchange, or shared consent by mutual interest, then you are able to construct commons in every possible means rather than by the one means of majority rule – and that the most effective method of constructing commons is to trade with other classes what you have to supply: labor and good normative public behavior, for knowledge, organization, and wealth. While at the same time, no one can create parasitic commons because no such contract can survive the test of natural law that all contracts must survive. Furthermore, without monopoly production of commons there is no reason for politicals to pass legislation or regulation, only facilitate the market for the production of commons – which is in all our interests, and requires very little that we ask of man’s character to work other than by natural incentives. Again, a legal system that takes its decidability from the natural law and evolves by empirical experimentation via the common law, with universal standing and universal applicability, combined with a market for reproduction (family), a market for production of goods and services (the economy), and a market for the production of commons (government in the loosest sense), is the most empirical and truthful non-parasitic order that we can construct.
