Why do Americans get it wrong? It’s with dismissive sneer to private and common (empirical) law traditions of tort, without compensating citizens for the damages. The private sector property rights tend to be better than the state violation of those rights.

There is no electoral college, no house of representatives, and no presidency. The senate remains, but consists of the governors of the several states. The powers of the government are severely constrained. The blue (immoral) cities are converted to city states, and ‘free cities’ able to customize their laws to their demands, but have no influence outside of their cities. The law prohibits all aspects of liberalism outside of free cities. My understanding is that the good (our) people will flee the cities, and the bad (their) people will fly to them, now that urbanity is offset by digital communications. This will make a small number of dense city states, dedicated to hyper-consumption (hedonism) and slums – and a large number of sparsely populated territorial states, dedicated to families and high trust commons. Over time minor cities will see transfers of population.

Law is what prohibits people like me and mine from profiting by conquering, killing, enslaving, enserving, tax farming, usury farming, selling theology, philosophy, ideology,pseudoscience, false promises of freedom from physical, natural, and evolutionary laws to people like you. Oh… Wait. Law is the contract between men capable of sufficient violence to produce institutions that satisfy their mutual interests. It just so happens that law, liberty, markets, and the eugenics of markets is the cheapest way to obtain the highest returns. Oh… Wait. Law is the set of terms under which we use violence to suppress irreciprocity that would incite further irreciprocity and in doing so undermining the cooperation that we call markets, economics, societies, polities and states. Oh… Wait. The natural law of truth, contract, reciprocity, warranty, and restitution is the only universal logic of decidability in matters of conflict that eliminates the incentive for retaliation cycles we call feuds, tribal, and city state warfare that have plagued man. Oh… Wait. Law is what prohibits people like you from violence, harm, theft, fraud, baiting into hazard, free riding, socialization of losses, privatization of commons, conspiracy, corruption, usurpation, conversion, immigration, displacement, conquest, and genocide. So that people like me can cooperate with you instead of killing, enslaving, en-serfing….you.
