PROPERTARIAN NATURAL LAW: EMPIRICAL NOT RATIONAL

—“I would say that your use of the term Natural Law, as opposed to the former englightment thinkers, is empirical (as opposed to their rational.) They used it to describe a set of innately known or knowable rules of moral behaviour. You are using it to describe a set of discovered rules which are necessary for cooperation.”—-Ivan Ilakovac

    Q&A: DEFINE ‘AGENCY’

—“CURT: Could you point me to any of your existing writing that develops your use of the term ‘agency’? I’m thinking more in legal terms (agent/agency), and wondering if that understanding is sufficient or if you have something different in mind.”— Andrew

    It’s not complicated. It’s:

**agency is the capacity for human beings to make choices**

Think of it as a soft version of ‘free will’.

When I use the term, and when most of us use it in the context of different abilities, we refer largely to the delta between fully deliberate, fully rational, fully informed, unbiased, decision making.

Conversely, a lack of agency occurs as various impulses, cognitive biases, disinformation, and error accumulate until the person in question is no longer what we consider reasonable or sentient.

So when we say ‘women lack agency’ we are referring to the impulses that affect them because of their reproductive roles, which bias them against the tribe (males), and limit their decision making in matters of the tribe (politics).

(it is very hard for women to think clearly compared to men unless it is about a subject that is reproductively important for a woman and her offspring survival. In this sense most women are political equivalent of color-blind, in the same way that most men are nesting-blind, or empathically blind. The analogy that a woman’s mind is like a version of Windows that keeps popping up modal dialogs sporadically and constantly. For men. We open a window and we don’t see another one until we open another one and close this one. We also think about a very small subset of (high risk) problems and women do exactly the opposite: think about a host of low risk problems. Why? we hunt. They take care of children. I can hunt next week. Children must be taken care of right now and today. it’s not complicated.)

    DEFINITION: NATURE

That which exists and changes state according to available operations imposed by the physical laws of the universe, independent of the mind or actions of man. In other words, existence free of imagination, error, bias, wishful thinking, suggestion, obscurantism, psueoscience and deceit.

a definition of “natural as in natural law. Nature (existence and operational predisposition within existence) is an archaic term, so I answered what I thought you meant. But I think you mean that the verbal relationship between ‘nature’ and ‘natural law’ is other than etymological. Natural Law = reciprocity. We use the term ‘nature’ pretty widely. But in origin it has both a positive and negative meaning. Like most things the negative is more precise: that which was not created by intent. Originally used as ‘a man’s nature’, and referring to his character and breeding just as we learn by domesticating the personality and fitness of animals.

The use of the term Natural Law generally refers to the attempt to bind states to the necessity of not imposing upon that which would inhibit cooperation and prosperity. In later generations this would be reduced to reciprocity in property rights. In the current period I use it to refer to reciprocity in property in toto, and suggest that this condition is only possible under sovereignty. And that sovereignty is only possible by militial reciprocity.

    DEFINITION: SCIENCE:

“The elimination of imaginary information from our statements of observation.”

Science: via-negativa: the elimination of imagination, error, bias, wishful thinking, suggestion, obscurantism, pseudoscience, or deceit.

The rest is ample curiosity, patience, discipline, hard work, and tool-making – whether those tools are cognitive and logical, or physical and measurable.

As the scale of our inquiry decreases to the small, or increases to the large, or peers into the past, or into the future, or into the fast, or into the slow, we must reduce that which we cannot perceive and compare to that which we can perceive and compare.

That process is largely a constituted in the development of logical and physical instrumentation by which we can sense and perceive and compare that which we cannot without the assistance of logical or physical instrumentation.

In other words, Science consists in that discipline under which we struggle to distill the truth from the results of free association within our imaginations (and the imaginations of others).

    DEFINITION: CIVIL SOCIETY

1 – Government Organizations (involuntary production of formal institutions) The ‘First Sector’ of society.

2 – Business Organizations (voluntary production of production) “The Second Sector of Society’

3 – Civil Organizations (voluntary production of commons) “The Third Sector of Society”

Civil society consists of the set of non-governmental, non commercial, organizations and institutions by which citizens bring their will into fruition. It includes the family, private relations, and volunteer organizations.

The ‘tiny privileged countries” of the north sea have effectively grown their governments from their civil society orders. This differs from the larger states that formed central governments across multiple areas, families, tribes, and often subcultures.

American civil society was rich until attacked by the government.

    DEFINITION OF A CORPORATION

A corporation: an organization of individuals and their capital which the government has granted limited liability to the members by restricting personal financial liability to the capital invested in the organization in the event of failure. The reason states provide this limited liability is to encourage the risk taking necessary for entrepreneurial activity, and to reduce the power of the financial system from engaging in moral hazard in order to profit immorally. The state, as in all things, functions largely as an insurer of last resort.

—“The modern corporate form of business organization evolved over many centuries. and despite a large body of historical research. its origins are still obscure. why. then, was the corporation invented‘? The early joint-stock companies in England embodied an important change in contractual form. Scholars have rationalized that these corporations evolved in response to an exogeneous increase in the demand for capital by the early foreign trading companies. Our complementary. supply-side hypothesis stresses the advantages that more readily transferable property rights held for the owner-managers of these early companies. These two hypotheses and the historical evidence on their relative importance will help explain the emergence of the corporate form of economic

  • Q:”WHAT’S PLATONIC PHILOSOPHY?” (first attempt) (pretty close) A: (a) referring

    Q:”WHAT’S PLATONIC PHILOSOPHY?”

    (first attempt) (pretty close)

A: (a) referring to (supplying information by) the extra-natural (a subset of the supernatural) in a justificationary argument – and specifically, references to extra normal ideals – instead of limiting references to the existential. More generally, (b) Plato and Socrates were literary (analogistic) philosophers producing dialogs. Aristotle was a descriptive (correspondent) philosopher. Plato invoked order (decidability) provided by the extra-natural, as a compromise means of avoiding the supernatural. (This appears to have been the greek innovation over the flood river authoritarian civilizations.) In other words plato conflated the mythical, literary, and rational, to produce authoritative arguments as a means of avoiding the mythical and supernatural authoritarianism of the theologists.

In the ancient world we saw another instance of the deflationary division so common in western civilization: the separation of decidability into a) law, b) science (aristotelian descriptive philosophy), c) literary envisionary philosophy and it’s companion history, d) platonic philosophy conflating a limited supernaturalism and literary philosophy, e) the continuation of theology: the conflation of law and supernatural mythology, and f) the Augustinian conflation of reason and theology. And all these ‘languages’ or ‘techniques’ persisted through the centuries.

The Anglos preserve aristotelianism, the french literary(rousseau), the germans have preserved platonism (kant et al). and the jews have conflated law, and pseudoscience, as a replacement for law and supernaturalism.

    CURT: WHAT’S OVERLOADING?

Overloading is accomplished by saturating the conversation, the authorship, the policy(legislation), the physical environment (advertising), and the propaganda(media) with confirmatory but not falsificationary information. The chief function of overloading is a form of exhaustion. with the knowledge at one’s disposal, and the energy and time available, one cannot economically afford to produce a refutation if in disagreement with the proposed actions. Meanwhile those in agreement with the proposed actions need not understand all that information, nor try to falsify it, only take confidence from it. In other words, it’s equivalent to dumping money or resources, products or services on an economy. It’s information. The information isn’t necessarily false. But by sphere volume it eliminates the possibility of correction for simple reasons of costs.

This is largely how the marxists achieved their ends: volume of lies.

    THE FUNCTION OF THE COURT

The function of the civil court is not to produce legislation from the bench but to return UNDECIDABLE legislation to the state for improvement or withdrawal. The same for the process of constitutional amendment, and constitutional convention: they were put in place so that the court could not do what it has done: legislate. The court of the presidency is called the senate. The senate sits as court on actions of the president. The majority of the problem began with the fourteenth (unconstitutional) amendment. and it is through that window that the rule of law, under natural law, requiring legislation for imposition upon that law, and limiting the federal government to commercial rather than normative cultural and civic matters, has been destroyed INTENTIONALLY by a program of raising specific cases before the supreme court as a means of achieving through legislation from the bench that which could not have been achieved by democratic means.
