False dichotomy.
All human beings are rational within the limits of their knowledge and ability. Therefore they act morally when it’s to their advantage, and immorally when it is to their advantage.
History consists of the incremental suppression of immorality through the incremental expansion of rule of law (natural law).
Ergo, discretionary rule is impossible as is stated in the OP, and Anarchy is impossible because of the discount on immorality imposes high transaction costs – something that is not stated in the OP.
The only possible means of moral rule is via the perfect decidability provided by Natural, Judge-Discovered, Common Law, and the resulting markets for association, reproduction(marriage), consumption(production distribution and trade), commons(territorial, physical, institutional, and normative capital), rule(of small states), and conflict (martial war, immigration war, economic war, religious war(conversion), and information war (propaganda and deceit).
We must end the fallacy of anarcho capitalism: it is nothing more than an attempt to circumvent the high cost of commons while taking advantage of the markets created thereby.
Anarcho capitalism is just as parasitic upon the commons as Communism is parasitic upon private property.
