    Kinsella uses the libertarian term “original appropriation” which says nothing other than an action that one seeks to bring a thing under his control and out of the control of others”.

    We use the word homesteading which is more appropriate (sic) because it means you’ve invested in an thing over time that was not previously invested in by others.

    Homesteading is the better term – but this might be one of those rare time we need a neologism. 😉

    We need a term that is the equivalent of homesteading that more generalzed and consists of the operational terms by which we bring our control over something into legitimacy by the costs born without impacting the costs born by others. We need to be creative about defining a new term.

    Primovestiture: From “primo” (first) and “investment.”

    Elements of Primovestiture
    Initial Investment: The human action of allocating resources—whether it’s labor, capital, or intellectual effort—to something previously unclaimed or undeveloped.

    Exclusivity: Ensuring that the actor is the first to make the said investment, effectively nullifying the possibility of dual claims over the resource.

    Non-Deprivation: The investment does not produce externalities that would impose costs on others, maintaining a state of Pareto efficiency.

    Utility in Decidability
    Primovestiture offers a criterion for the decidability in disputes over initial claims by providing an axiomatic foundation based on natural law. If an action satisfies the principles of Primovestiture, then it has achieved a state of ethical legitimacy and should be universally preferable within a given legal system. It also dovetails with performative truth, as the action itself, when conducted under the constraints of Primovestiture, reveals a truth about the legitimacy of ownership.

    Cross-disciplinary Application
    Given your focus on unifying multiple fields under the banner of Natural Law, Primovestiture can serve as

    2. Consult Existing Terminology
    Terms like “usufruct,” “first appropriation,” and “stakeholding” might provide inspiration but aren’t adequate to capture your concept entirely.

    3. Experiment with Word Creation
    Primovestiture: From “primo” (first) and “investment.”

    4. Assess the Term for Clarity and Applicability
    The term should be self-explanatory to some degree.
    It should be broad enough to apply to various contexts, from natural resources to intellectual property to social and economic capital.

    5. Introduce the Term in Academic and Professional Circles
    A white paper or academic article that outlines the theoretical framework can serve as an introduction.

    I don’t think much of academia but this might be one of those cases where it’s useful.

    There is no good guy. There is a serious problem. That is that the romans disposessed the jews for their failure to demonstrate minimum loyalty to the laws of the empire. This led to over a millennia of conflict between our peoples due to the incompatibility of our ethics and morals. Beginning in the 19th century in England, europeans sought to correct this ancient problem and restore the jews to their homeland. This project failed or the holocaust wouldn’t have occurred. Postwar, the west tried to solve this problem – in no small part because the west continued to not want the jewish people in the west. However, the people could not cohabitate, war resulted, and the state of israel became a mission of restoration for at least some of the jewish people (zionists). Now, this displaced the palestinians who, as a conquered people, rebelled against their defeat and continue to. This problem is only solved by war, resettlement, and time. Because it is a matter of survival for the Israelis and the jewish people. A fact which will come into greater clarity again “because it’s happening again for the same reason it always does”, and the necessity of a homeland will only increase in urgency and dedication as it happens. Meanwhile a culturally economically, technologically and politically superior half european people are conquering and displacing and repalcing a people inferior by all of thse same measures.
    Now I have only written one philosophical piece on this situation that is universal all similar contexts: whatever people and culture builds the first cities, infrastructure, and monuments and states (“original appropriation”) is the territorial owner of that land even if they are dispossessed by others. If you did not improve the land, then you were a user, a parasite, but not a producer of ownership by investment. The temple is enough for eternity. Any claim otherwise is theft. This applies to not only Jerusalem but to Constantinople.

    In this sense, might can make right or not, and is required to make rights, obligations, and inalienations: all of them.

    Yeah. While I do find value in bringing the issue of the incompatibility of MENA culture and the West, I’m not gonna bite on this jewish and muslim nonsense. Just because I work on the truth of what each group has done or failed to do, does not mean I work from any position other than the love of mankind. The fact that I criticize any given culture and call out their behavior, tradition, institution, culture, set of values, metaphysical presumptions, and group strategy – is so that we can reform the law to prohibit the crimes that seem to ferment and spoil out of the the middle east and central asia – and sometimes east asia. I do criticism to end behavior that causes conflict and hatred. And the weapon I choose is the law we must all surrender our desires for criminality to. If the people cannot do it – that’s fine. Only the people who can matter.
