The court isn’t making revolutionary changes to the law. They are restoring rule of law that was undermined beginning with the warren court and the positive legal sophistry of Rez, Kelsen, Dworkin et al: the Freudian, Boazian, Marxist, Neo-marxist, Pomo version of jurisprudience.
