We design our governments for cooperation, but we experience both wars and windfalls that require – because of human nature – monopolization of resources during war, and distribution of gains during windfalls.The problem is the accumulation of rents. That’s the problem. Solve it.

@fryskefilosoof There is only one law, and one constructs rule of law under that law or one does not. As such all legislation (contracts of the commons) and regulation (rules of implementation) are simply contracts yes. However, there consist three states of a polity: War, Cooperation, Windfall.
