    Limited liability is an extension of the function of insurer of last resort to investments, so that individuals can take risks limited to the invested capital unless they engage in fraud. The problem with corporations is that the state has usurped our ability to sue them for impositions of costs on the various commons. This is a simple fix to rule of law.

    The problem with competency is that the superior is liable for the ignorance of the inferior, while the superior has every incentives to profit from the ignorance and incompetence of the inferior. Hence the question of ghetto vs aristocratic ethics: whether you do not (ghetto) or do (aristocratic) demand paternal due diligence. And the western answer is “yes”.

    Well, the conclusions should be pretty obvious (prior restraint vs post resolution) and that all countries pay a trade off between the utility of some regulation to prevent frauds of all sorts, lots of regulation to prevent malinvestment or tax evasion, and post-hoc litigation to encourage experimentation.
