Well that’s an origination by assumption on your part. That is not what aristotle or aquinas or the scholastics, or blackstone, or the founders where thinking.

It’s that we should make laws that improve the police that are empirically discovered and rationaly explained by the evidence of human behavior in both failures and successes of cooperation.

In other words, it’s a claim that legal legitimacy is the product of empirical evidence not of arbitrary discretion of a ruler.

(which gets us back to your and my difference of opinion on the meaning of authority – a meaning that I keep open just because I enjoy it so much. 😉 )
