The court does not produce one-hit-wonders very often. It makes narrow decisions, that accumulate over time. If there is a pattern of abuse another suit will come before the court and plug that loophole.

WHile this seems inefficient to the public it is a very scientific approach to the production of minimum constraint rather than overreach.

The court is in the process of correcting past overreach by previous activist courts, that violated the constitution and the natural law, by circumventing the people, their concurrency, and the legislature, before we had collected enough information and experience about human nature given the new freedoms made possible by the industrial technological and medical revolutions, and the economic, neurological, science revolutions – revolutions that we presumed human nature was more optimistic than it has proven.
