5 to 1 isn’t a narrow ruling. This was never going to survive the courts. The federal govt has taken on the responsibility of regulation, and of insurer of last resort. “If it wasn’t law it wasn’t crime”. Instead, why isn’t the FDA and Congress responsible for it?
