Hmm.. Well, those two things can be true at the same time. The ‘equality under the law (court)’ is a ‘term of art’ that refers the reduction of questions of dispute resolutions under the law to those of property, tort, equity, and restitution wherein, in some cases, both parties share some fault in creation of the dispute, and where factors external to those questions (status, position, wealth) have no bearing upon the decision.
So the court can treat parties equally in those terms while still discovering that one party or the other is at fault.
You might be saying that internal and external parties are unequal and that would be true in some cases, but in our work we would still determine the case by demonstrated interests (property), tort (violation), equity (subtlety), and restitution (restoration).
